Wills and Probate

 

What is probate? Probate is the process of transferring the property and belongings of a person who has died to their heirs. Though the loss of a loved one can be a difficult and emotional event, the probating of their Will should be neither. Texas has been at the forefront of simplifying this process. Many estates can be probated in only one court hearing. Such cases require the filing of an inventory and the appointment of an independent executor/ executrix. So long as The Last Will and Testament is properly drafted, probating a will can be completed within 120 days. However, when an individual dies without a Will, Court supervised dependent administration can be the only avenue available. This process can be longer, and require express consent form the Court at each step.
